Acceptance of the Terms & Conditions
These Terms & Conditions are entered into by and between you (“you,” or “User”) and the owner, doing business as The Model Mindset (“Company,” “we,” or “us”). These Terms, together with our Privacy Policy and Earnings Disclaimer, govern your access to and use of our website and all programs, courses, coaching services, digital materials, and related offerings.
By accessing our website or purchasing any offering, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use our services.
Changes to the Terms
We may update these Terms at our discretion. Changes become effective when posted. Your continued use of our website or services constitutes acceptance of those changes.
Age Requirement
You must be at least 18 years old to purchase or enroll in any offering. By purchasing, you confirm that you meet this requirement.
Access & Account Security
We reserve the right to modify, suspend, or discontinue any portion of our website or services without notice. We are not liable if any part becomes unavailable.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may disable access if misuse is suspected.
Nature of Services & No Agency Representation
The Model Mindset provides modeling education and mentorship. We are not a licensed talent agency, modeling agency, or management company. Participation does not create a representation, employment, or fiduciary relationship.
We do not procure modeling work, negotiate contracts, or act on your behalf with agencies, brands, photographers, or third parties.
No Guaranteed Results
Modeling outcomes depend on market conditions, agency demand, timing, and individual effort. We do not guarantee agency representation, contracts, bookings, social media growth, or income. Testimonials reflect individual experiences and are not assurances of similar results.
Coaching Boundaries
The Model Mindset provides education, mentorship, modeling guidance, and mindset coaching. We do not provide therapy, psychological counseling, medical treatment, nutritional treatment, or mental health services.
If you are experiencing mental health challenges, body image distress, eating disorders, trauma, or emotional crisis, you are encouraged to seek support from a licensed medical or mental health professional. Participation in our programs does not create a therapist-client or medical provider relationship.
Seats and Scope
One purchase grants access to one individual unless otherwise stated in writing. Sharing login credentials or providing access to additional individuals, teams, clients, agencies, or classrooms is prohibited.
Delivery and Technical Requirements
Digital products and course materials are delivered electronically through email, download link, or online platform access. You are responsible for maintaining compatible devices, software, and reliable internet access. We are not responsible for technical limitations on your end.
Payments, Financing & No Refund Policy
All purchases are final and non-refundable. By purchasing, you acknowledge and agree that no refunds will be issued for any reason.
We may offer the option to use third-party financing providers or buy-now-pay-later services, such as Klarna, Affirm, or Afterpay, to facilitate payment. By selecting a third-party financing option, you acknowledge and agree that your financing agreement exists solely between you and the financing provider. We are not a party to that agreement and do not control approval decisions, interest rates, repayment terms, fees, or credit reporting practices.
You are fully responsible for all payments, interest, late fees, penalties, and obligations required under your financing provider’s terms. We are not responsible for missed payments, declined charges, credit impacts, or disputes arising from your financing arrangement.
All purchases remain subject to our no-refund policy regardless of financing approval or payment method.
Failure to complete any required payment, whether through a payment plan or third-party financing provider, may result in suspension or permanent termination of access to programs, materials, or services at our discretion, without refund, and without releasing you from your remaining payment obligations.
No Chargebacks
You agree to contact us first to resolve billing issues. Initiating a chargeback while retaining access to materials constitutes a breach of these Terms. We reserve the right to provide proof of access and pursue recovery of unpaid balances.
Intellectual Property
All original content created and provided by The Model Mindset, and our offerings, including course videos, coaching materials, guides, voice recordings, downloads, branding, text, graphics, logos, designs, and proprietary frameworks, is owned by us or our licensors and is protected by copyright and trademark laws. Nothing in these Terms transfers ownership to you.
You may not copy, reproduce, adapt, repurpose, distribute, or use our content in whole or in part for the creation of competing products, services, programs, or materials without written permission. Any attempt to present our intellectual property as your own constitutes plagiarism and a material breach of these Terms. We reserve the right to terminate access and pursue legal remedies.
Some content shown in our programs, marketing, or website may include images, videos, screenshots, social media posts, or other media created by third parties, including content creators, influencers, models, photographers, agencies, brands, or production companies. Such content remains the property of its respective owners and is displayed for educational, illustrative, commentary, or example purposes. We do not claim ownership of third-party content. You may not copy, reproduce, distribute, modify, publish, or otherwise use any third-party content for any purpose.
Unauthorized use of our content or third-party content may result in termination of access, legal action, and reporting to the applicable rights holders.
We reserve all rights not expressly granted.
Community Conduct
You agree to conduct yourself respectfully in any coaching session or community space. Harassment, discrimination, defamation, or misuse of materials may result in removal without refund.
Non-Disparagement & Internal Resolution
You agree not to publish or communicate any false, misleading, or defamatory statements about The Model Mindset, its owner, programs, services, or representatives.
If you have concerns, complaints, or disputes regarding any offering, you agree to contact us directly at [email protected] and allow a reasonable opportunity to resolve the matter before initiating public claims, chargebacks, or third-party disputes.
Nothing in this section restricts your right to share truthful experiences or to report unlawful conduct to appropriate authorities.
No Unlawful or Harmful Use
You agree not to use our website, programs, or offerings to violate any law, infringe intellectual property rights, harass or harm others, transmit malware, attempt unauthorized access, or interfere with the operation or security of our platforms or services.
Third-Party Platforms, Industry Risk & Independent Responsibility
Our programs may reference, integrate with, or involve third-party platforms and services, including course hosting platforms, questionnaire forms, social media networks, video conferencing tools, booking systems, email or SMS communication services, and payment processors. These providers operate under their own terms and privacy policies. We are not responsible for outages, technical failures, policy changes, account suspensions, algorithm changes, service interruptions, or platform decisions. You are responsible for maintaining the necessary internet access, devices, and software required to use our offerings.
Participation in the modeling industry involves independent decisions and third-party relationships, including agencies, scouts, photographers, production professionals, brands, clients, casting platforms, and other industry participants. We do not control and are not responsible for their decisions, conduct, contract terms, payment practices, acceptance or rejection, nonpayment, misrepresentation, fraudulent activity, scams, misconduct, unsafe environments, travel risks, or any physical, emotional, reputational, or financial harm arising from third-party interactions.
You acknowledge that you are acting as an independent individual in managing your modeling career. You are responsible for evaluating opportunities, reviewing and signing contracts, seeking independent legal or financial advice, negotiating terms, communicating with third parties, and managing your professional commitments.
The Model Mindset is not liable for agreements you enter into, decisions you make, or outcomes resulting from third-party relationships.
Recordings & Marketing Use
Coaching calls, group sessions, and sales calls may be recorded for quality and documentation purposes. By participating, you acknowledge and consent to being recorded. We may use recordings, excerpts, screenshots, chat comments, or testimonials for training, quality control, promotional, educational, or marketing purposes. If you prefer not to be identified by name, you must notify us in writing prior to participation. You grant us a nonexclusive, worldwide, royalty-free license to use such recordings for these purposes.
Limitation of Liability
To the fullest extent permitted by law, The Model Mindset shall not be liable for indirect, incidental, or consequential damages, including lost modeling income, lost opportunities, emotional distress, or reputational harm. Our total liability shall not exceed the amount you paid for the specific program giving rise to the claim.
Termination
We may suspend or terminate access to any offering for misconduct, breach of these Terms, nonpayment, or misuse of materials. Termination does not release you from any outstanding payment obligations.
Force Majeure
We are not liable for any delay, interruption, or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, war, terrorism, labor disputes, internet or platform outages, power failures, or other unforeseen events. In such circumstances, we may modify, suspend, or reschedule services as reasonably necessary.
Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Florida courts unless we elect to require binding arbitration. You waive the right to participate in any class or collective action.
Notices
Email is the required method for official communication. Notices to us must be sent to [email protected]. We will send notices to the email address associated with your purchase.
Privacy & Data
We collect and process personal data in accordance with our Privacy Policy. By purchasing or participating in our offerings, you consent to this processing.
